When or under what conditions can I file for divorce?

In the state of North Carolina, you can only file for divorce if you have been separated from your spouse for one full year. No circumstance can change this requirement.

Don't mothers always get custody of young children?

No. Custody of children is always based on what the judge thinks is in the best interests of the children. This may mean that the children will live primarily with the mother, primarily with the father, or equally with both parents. The judge does not always think that it is in the best interests of the child to be with the mother.

Does "Joint Custody" mean that I have to share time with my child equally with the other parent?

No. Parents can have joint legal custody of a child and have many different types of arrangements for physical custody.

Someone told me that their attorney guaranteed that they would win their case and get their kids.
